Q. Well, how continuously was the water used in that ditch, Mr. Thomas?
By Mr. Rasch. - We object to this as immaterial and irrelevant, not pertinent to any of the issues in this case. In fact, nearly all of the testimony given here by the witness in relation to ditches taken out on the south side of the creek is wholly immaterial and irrelevant.
A. Well, it was used by different parties; I used some for this lower place of mine before I went into this other ditch, and Mr. Edwards used some down there.
