The instructions of the Court were given to the jury in writing (trans. Pp. 72 After retiring, the jury brought in a verdict for plaintiff (defend ant ih error), and assessed his damages at the sum of One Dollar. (trans. P. The Court, however, upon his own motion refused to receive said verdict; stated to the jury that his instructions were too favorable to defendants, and directed the jury to retire and find a greater amount of damages in favor of plaintiff (trans. P. The jury, after retiring, returned again with a verdict of Six Hundred and Fifty Dollars, which was One Hundred and Fifty Dollars more than the gross amount of gold taken from the property. The verdict was ao cepted and the jury discharged. A motion for a new trial was made, and with consent of plaintiff the amount of the judgment was reduced to the' sum of Four Hundred and Fifty Dollars and the mo tion denied. (trans. P.
