Excerpt from Twenty-Second Annual Report of the Department of Public Health of Massachusetts, 1936: Report of the Public Health Council
Chapter 247 of the Acts of 1936 provided for an Approving Authority consisting of the Secretary of the Board of Registration in Medicine, the Commissioner of Education, and the Commissioner of Public Health, to pass on the qualifications of applicants for registration as qualified physicians. This requires the setting up of standards for colleges giving pre - medical courses and for medical schools In order that their graduates In medicine may be eligible to take the examination for a license to practice in the Commonwealth.
Chapter 144 of the Acts of 1936 provided for the payment of military and other emergency expenses in safeguarding the lives and preserving the health and safety of the inhabitants in the areas of the Commonwealth damaged by ?oods, and carried an appropriation of $7 The administration of this relief was carried out under the direction of a board consisting of the adjutant-general, the Commissioner of Public Health, the Commissioner of Public Welfare, and the Commissioner of Public Safety. The board had many meetings to pass on claims brought by communities and individuals who suffered damage as a result Of the ?oods.
Chapter 430 of the Acts of 1936 amended certain provisions of law relative to the determination and establishment of minimum fair wage standards for women and minors. The Minimum Wage Commission thus established was placed In the Department of Public Health under the control of the Commissioner of Public Health, and consists of the Commissioner of Labor and Industries who shall act as Chairman, the Commissioner of Public Health and the Commissioner of Public Welfare. The reason for this change in the statute, taking the Minimum Wage Commission out of the Department Of Labor and Industries and placing it under the Department of Public Health, was because a similar law in New York State had been declared unconstitutional by the United States Supreme Court. It was reasoned that if a minimum wage law was based upon the assumption that un reasonably low wages would result in impairing the health of the workers it would be considered a health measure and the Courts would uphold its constitutionality. After the passage of the act, the Commission was organized and new wage boards have been appointed representing the employer, the employee and the public to consider the twenty-two trade classifications. When these boards report their findings and recommendations, hearings are held by the Commission who approve or disapprove the recommendations relating to wage scales and hours of labor for the different trades.
