Excerpt from The State of Ohio, General and Local Laws and Joint Resolutions, Vol. 68: Passed by the Fifty-Ninth General Assembly, at the Adjourned Session, Begun and Held at the City of Columbus, January 3, A. D. 1871, and in the 69th Year of Said State
Section 118. If the issue on the plea in bar be found against the defendant, or if upon the arraignment the accused offer no plea in bar, he shall plead guilty or 1' not guilty but if he plead evasively, or stand mute, he shall be taken to have pleaded not guilty.
