First. There are the thirteen original states and those carved out of territory claimed by them, to which may be added Tennessee and Texas. In this group the individual state was the paramount proprietor of mineral lands and hence the sole source of law regard ing mining and the cases are decided either according (1) to the general principles of the common law system or (2) according to the laws enacted by the state legislatures.
