Publisher's Synopsis

Constitutional law is becoming more international, constitutions are becoming more standardised, the rule of law as a protector of subjective rights is becoming more universal, and constitutional justice is increasingly finding its way into the various political systems of the states. Constitutional review has become a symbol of the proper functioning of state institutions. In the context of the globalisation of democratic legitimacy, it is becoming the criterion of political credibility. Tunisia has not failed in this movement. The various constitutional and legislative revisions from the 1990s onwards aim to carry out the reforms necessary to meet these requirements. The Tunisian Constitutional Council is gradually coming closer to the model of 'constitutional justice', and the Tunisian Constitution of 1959, the means and end of this process of modification, remains the focus of interest and the foundation on which the constitutionality judge bases himself in order to derive and deduce all the reference standards. These norms are of a different legal nature and are situated at different hierarchical levels.
