The dissemination of a false advertisement by any means for the purpose of inducing, directly or indirectly, the purchase of drugs or cosmetics.
Provided, however, there shall be no prosecution of any li censed retail merchant for violation of the provisions of Section 1664 - c of this act until the said retail merchant has been adequately warned by the State Board of Pharmacy that the drug or cosmetic in question is adulterated or misbranded.
