Intellectual property rights reflect an inherent tension between the strong desire to promote and reward creative energy and the desire to make the fruits of that creativity available to the public. Therefore, intellectual property rights involves right to protect such as the fostering of innovation and creativity as well as access to and use of new technologies which in turn involves development. In one way or the other development is affecting environment. Thus, intellectual property should be used in integrating environment and development. The adoption of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) has brought about momentous changes in environmental law and policy making at the national level.
