The defendant admits that Wm. M. Stewart, D. 'e. Av ery, Lou1s Janin, jr., H K. Mitchell, and A. Sutro, as Trustees ofthe Sutro Tunnel Company, made and executed the articles of agreement, as appended to the plaintiff's complaint, and marked exhibit B, with the plaintiff, and made similar articles of agreement about the same time with other-persons, associations, and companies then en gaged in working mines on the Comstock lode.
