Nè più sostenibile, sia dal punto di vista del diritto classico, sia anche da quello del diritto giustinianeo, è il tentativo di conciliazione secondo il quale si avrebbe deposito per quanto irregolare, quando si pattuisca tosto espressamente o tacitamente la restituzione del tan tandem, o anche l'immediata facoltà d'uso, mutuo invece, quando, e posteriormente al deposito si accordi la facoltà d'uso, 0 anche tosto.
