Excerpt from Statement of the Claim of Charles F. Sibbald Against the United States: Embracing the Points Suggested in the Instructions of the Attorney General, to the Third Auditor
The orders and instructions under which the government agents acted were made to extend to all unconfirmed Spanish grants, and the con struction put upon them by the agents seems to have been concurred in and confirmed by the Executive Departments, as they were fully advised of the conduct of their agents in the premises, and repeatedly and earn estly called upon by the petitioner to modify their instructions, and to interfere and prevent the loss and damage which would result to him therefrom. They were issued, doubtless, for the laudable object of protecting the public lands from injury and spoliation, especially of the live oak, so necessary for the navy. Still, however, if in thus protecting the interest of the United States, an individual, like the petitioner, has been seriously injured, the obligation to make him reparation is not weakened thereby. The acts of the authorized agent or agents being approved by the government, it must be considered their act, and the injury, ifany, to the petitioner, must be responded to by them.
