On the l3th October, 1840, The American Life and Fire Insurance and Trust Company filed their bill against Peter M. Ryerson and wife, and others, to foreclose a mortgage, dated July 10th,1835, given by Ryerson and his wife to the said com pany, to secure the payment of a bond of the same date, given by Ryerson to the company, conditioned for the payment Of in five years from date, with interest, payable half yearly; with a provision that in case the interest should at any time be in arrear for ninety days, the whole principal should be forthwith paid. Two years' interest was due when the bill was filed. To this bill Ryerson filed an answer, oii the 24th May 1841, setting up usury. On the 6th of July, 1842, the com pany made an assignment to Patrick mccauley, Geo. F. Talman and Anthony Barclay, in trust, 850.
