Excerpt from Reports of Cases Argued and Determined in the Supreme Court of Alabama, Vol. 39: During the January and June Terms, 1863; January and June Terms, 1864; January Term, 1865; And the January Term, 1866
It is ordered by the Court, that the Rules of Practice of the several Courts of this State, inserted by Hon. A. J. Walker, Commissioner, in the Appendix to the Revised Code of the State of Alabama, be, and the same are hereby, adopted and all other Rules of Practice, heretofore adopted by this Court, are hereby repealed. -may 7, 1867.
Rule 34. Cross assignment of (arrow - The appellee can only assign errors upon the record brought up by the ap pellant, by consent of the appellant, in writing, endorsed on the transcript, and a joinder by the appellant in such assign ment of errors. When such assent and joinder are made, the clerk shall docket the case, as if an appeal had been taken by such appellee, and the transcript Shall be a part of the record in the case Wherein errors are thus assigned by the appellee, as well as in the original case; and the case in which the appellee thus assigns errors Shall, in all respects, be regarded as a case on appeal taken by him.
