It occurred to me, whether, if the East India Company had stated an account under the agreement of 1781, and reciting they had received so many lacks of pagodas from the revenue, that they had debited him so many lacks, upon which remained a balance of so many pagodas, with or without saying they would promise to pay it; and if the N abob were to bring an action in the court of King's Bench, or any other court of law, a plea could he invented to bar that action whether it had been worded ever so well, it would have applied to that subject; and, more particularly, how a plea, worded as this is, would apply.
