I do not know that all the members of the court agree with me in the conclusion, as to the abrogation of this punishment in Eng land by disuse; but in the inquiry most important, there is no differ ence of opinion. We all agree in this, that this customary ancient punishment for ducking scolds was never adopted, and therefore is not the common law of Pennsylvania.
