See). 4. The Territorial Controller is hereby made ex-ofii cio the Superintendent of Public Instruction, and he shall at the close of his official term, deliver to his successor all proper ty, books, maps, reports, records and all other documents, pa pers and property received by him for the use of, or belonging to his Office.
Sec. 5. For the purpose of establishing and maintaining Public Schools in the several counties of this Territory, it shall be the duty of the County Commissioners of each countv at the time of levying the taxes for county and territorial pur poses to levy a tax of not less than one mill nor more than five mills on each and every dollar of taxable property in their said county: Provided, however, That the tax SO imposed by the County Commissioners of Ada county, shall not be less than five mills on each and every dollar of taxable property in said Ada county, and said taxes shall be assessed and collected in each county as other taxes on roperty for count and territo rial purposes: Provided, fart er, That the Tax ollectors and Treasurers of said counties shall not receive any fees for said collecting, holding or distributing of taxes for school urposes, but sliall perform said duty without fee or reward, an the said moneys so collected, are hereby appropriated to the support of the common schools of each county established under the pro visions of this act, and shall be paid over to the County Treas urer of each county, and by him kept in a separate account, to be called the county of school (i, and shall only be drawn from each county treasury in the manner hereinafter prescribed.
