What does a man do who submits his case to arbitration? That is the very threshold of the inqury. Does he say, I am perfectly willing some person shall compromise this case for me? Does submitting his case to arbitration mean he is necessarily going to lose something? Does it mean he surrenders the guarantees of the constitution and the rights which he has acquired through enactment of law? That his rights are to be determined without ref erence to the economic laws which govern his business and govern all business? I take it that it does not. I think the fact that that has not 'been made clear in the past has deterred many persons from bringing their controversies to Boards of Arbitration. If it is a settled proposition that a man who submits his case to arbitration is bound to lose something, that it is nothing more or less than a compro mise arranged by some person or persons who may think this party might be satisfied with that, and the other party might be satisfied with the other, and in that way the parties can be brought together and further disputes prevented, then, arbitration, in my judgment, has received a blow from which it will never recover; but, if arbitration means that a man may come before a board Of arbitration and say, I am conducting my business according to law; I am conducting it according to true economic principles; I am not violating any law of the land or any law of the humanities, that man may be sure that he has a right to win his arbitration, and whenever he is assured of that right, he will be very glad to submit his case to arbitration.
