English summary: German administrative law regarding higher education has been changed profoundly by the university reform. The main topics on the political reform agenda are commodification, hierarchical restructuring, denationalization and administrative professionalization. The foundations of the traditional university organization (based in particular on democracy, equality of the academic staff, and academic self-government) have been deeply shaken as a result of this. In addition, even the general principles of administrative law have proven to be unable to explain these new attempts at administrative reform. In this work, Klaus Ferdinand Garditz assesses the current situation of university organization in relation to administrative law, academic freedom and academic self-government. In doing so, he deals with the current debate on the administrative law reform and in particular administrative organization.
German description: Die Hochschulorganisation befindet sich erneut in einer Phase des Umbruchs. Okonomisierung, Hierarchisierung, Entstaatlichung und administrative Professionalisierung bezeichnen Leitbilder, welche die traditionell kollegiale, akademisch-fachliche und auf Betroffenenreprasentation grundende Hochschulbinnenorganisation erschuttern. Dies irritiert auch die uberkommene Verwaltungsrechtsdogmatik, die bislang Fragen der Verwaltungsorganisation eher als instrumentelle Randprobleme behandelt hat. Klaus Ferdinand Garditz unternimmt im vorliegenden Buch eine Standortbestimmung des Hochschulorganisationsrechts im Spannungsfeld von Allgemeinem Verwaltungsrecht, Wissenschaftsfreiheit und akademischer Selbstverwaltung. Dabei werden auch grundsatzliche Strukturfragen des Verwaltungsorganisationsrechts aufgeworfen und ihre Bezuge zur Reformdiskussion in der Verwaltungsrechtswissenschaft kritisch beleuchtet.
