A major savings bank grants a mortgage loan to a developer to build a shopping center. The center is built and operates successfully 'until one day the owner receives a notice from the state that the center has been built on land on which buried leaky oil tanks are polluting a nearby water source. The owner is ordered to clean up the waste pursuant to the provisions of a state Superfund law. Since the cash flow from the center is insufficient to provide funds to comply with the state order and to pay interest and principal on the mortgage, the developer defaults.
