English summary: Volume 4 of Hans Kelsen Werke (HKW) gathers a total of seventeen contributions, each rather different in format, style and content, from the period immediately after the dissolution of the Dual Habsburg Monarchy in October 1918 up until the consolidation of the First Republic under the Federal Constitutional Law of October 1920. In these Kelsen firstly addresses issues from the time that relate to constitutional law, such as the position of the federal states in the future constitution or the right to vote. Secondly in this creative phase we see the emergence of his first systematic studies on the nature and value of democracy. And thirdly, Kelsen rounds off and consolidates his Pure Theory of Law, on which he had been working on since 1911, with the completion of the fundamental works Zur Theorie der juristischen Fiktionen (on the theory of legal fictions), in which he deals with Vaihinger's Philosophie des Als Ob (philosophy of the as-if), and Das Problem der Souveranitat und die Theorie des Volkerrechts (the problem of sovereignty and the theory of international law), in which he includes international law in his legal theoretical analysis for the first time.
German description: Band 4 der HKW vereinigt insgesamt 17 von Format, Stil und Inhalt her sehr unterschiedliche Beitrage Kelsens aus der Zeit unmittelbar nach Auflosung der k.u.k. Doppelmonarchie im Oktober 1918 bis zur Konsolidierung der Ersten Republik unter dem Bundes-Verfassungsgesetz vom Oktober 1920. Darin widmet er sich erstens seinerzeit aktuellen staatsrechtlichen Problemen wie der Stellung der Lander im kunftigen Verfassungswerk oder auch dem Wahlrecht. Zweitens fallen in diese Schaffensphase die ersten systematischen Studien zu Wesen und Wert der Demokratie. Und drittens arrondiert und konsolidiert Kelsen mit den Grundlagenarbeiten "Zur Theorie der juristischen Fiktionen", in der er sich mit Vaihingers "Philosophie des Als Ob" auseinandersetzt, und "Das Problem der Souveranitat und die Theorie des Volkerrechts", in der er erstmals das Volkerrecht in seine rechtstheoretische Feldvermessung einbezieht, die seit 1911 entwickelte Reine Rechtslehre.
