Comentario. Se considera punible la tentati va y no el hecho consumado, porque éste no constituiría delito donde quiera que impere el gobierno representativo, solo sujeto a las leyes aceptadas por la voluntad general. Si todos los peruanos, 6 el mayor número de ellos, ah jurasen del catolicismo para abrazar una reli gión diferente; dejaria de existir el articulo 4.° dela Constitución, no habría en el hecho vio lación de ley, ni perturbación del estado de de recho, que legitimase la imposición de un cas tigo.
Pero ¿qué hechos concretos pueden ser cali ñcados como tentativa para abolir ó variar la religion católica?
