Publisher's Synopsis
The revision of the commentary on §§ 241 ff considers relevant case law and literature, which is especially extensive due to the reform of the law of obligations. In addition, significant proposals contained in the reform are described. This edition presents the most current status of the long-standing debates regarding the establishment of a comprehensive body of laws for private law, which has found its provisional conclusion in a "common reference framework". The commentary to § 242 takes into account a number of new applicable cases, specifically in the law of sale of goods, which were considered by case law and literature after the reform of the law of obligations. In the field of family law, the effects of the Reform of the Duty of Family Maintenance 2007/2008 are especially taken into account. In conclusion, the volume contains a revision of the section dedicated to the meaning of § 242 in insurance contract law, which was dealt with extensively by the VVG Reform in 2007/2008 (Versicherungsvertragsgesetz: Reform of German Insurance Contract Law).
