Publisher's Synopsis
This study is dedicated to one of the most prominent discussions in German criminal law: the concept of assets. According to the so-called strictly economic approach, the monetary value alone determines the characterization of assets. However, case law and legal literature often also take normative aspects into account. As a thought experiment, this study asks to which extent an economic approach can address normative aspects based on Niklas Luhmann's theory of the economic and legal systems.
