State aid and public procurement law are in two constellations. So far, more attention has been paid to "receiving aid through the award of contracts", although the upstream interface of the "recipient of aid in the award of contract" has been dealing with legal practice and science for more than ten years. The present work now presents a new approach and systematically examines the participation of beneficiary bidders in tenders for the first time. In a cross-legal approach, procurement-related procurement law initially examines both offer-related and provider-related exclusions. This is followed by the transfer of the knowledge gained to non-harmonized public procurement law. The socio-economically important special regime in public transport (VO 1370/2007 / EG) is also taken into account, which has already provided most of the visual material for this interface problem in the past.
