The object of this treatise is' to fill this long-felt want; and if the design of the author is but partially realized, he will have the consciousness of at least hav ing pointed out the general principles of this branch of the law. To accomplish his purpose, he has dili gently compiled and compared both the English and American authorities preparing his text directly from judicial determinations, strenuously avoiding all spe culations as to the law. He has also endeavored to state all propositions as brie?y and concisely as is con sistent with clearness.
