This draft criminal code for South Africa attempts to formulate the rules for principles of the common law relating to the substantive criminal law which one would normally expect to find in a criminal code. The aim of the code is to formulate the rules of the criminal law as applied by the courts.;The first part of the code sets out certain principles relating to the general rules of criminal liability, including certain general defences. The second part contains definitions of the specific offences. An explanatory commentary on the formulation in the code is also provided.
