Publisher's Synopsis
The Civil Code sections 312 - 312f on new forms of distribution are commented on in great detail. They are on a sound dogmatic basis, with an eye to practical reality. The internet is increasingly becoming an established outlet for the retail trade. In consequence the rules governing sales via the electric media and e-commerce contracts are gaining in significance. The application of the EU guide line on electronic sales of financial services to consumers leads to important changes of sections 312b - 312d. Consumer protection regulations must now be applied to electronic sales of financial services as well. The changes introduced as a result of the EU guide lines are effecting the scope of application just as much as the duty of the entrepreneur to provide information and the right of the consumer to rescind the contract. The "Staudinger" is the first large-size commentary which extensively and thoroughly discusses the changes of sections 312b - 312d, which became effective at the end of 2004.
